Terms and conditions of sale
These terms govern the distance sale of the products offered on the Fantasia di Dolci website. Please read them carefully before placing an order.
1. Who we are
The website, software and e-commerce platform are the property of ByteTech OÜ, Sepapaja tn 6, 15551 Tallinn, Harju maakond, Estonia, Reg. 17558441, VAT EE103036861, email info@bytetech.ee ("ByteTech" or the "Website Owner").
Products are sold by Dolciumi da Franco e Agnese e Figli S.A.S di Giuliano Raffaele & C., Via Siepe Nuova 15, 80027, Frattamaggiore, NA, Italia, 10939091210, NA - 1143680, email dolciumidafrancoeagnesesas@gmail.com, certified email dolciumidafrancoeagnese@pec.it, phone +39 3337888311 (the "Seller").
The sales contract is concluded solely between the Customer and the Seller. ByteTech OÜ provides the technology platform and payment services via Stripe and is not a party to the sales contract.
2. Scope
These terms apply to purchases made on the website by consumers (individuals acting for purposes outside their trade or profession) and, where compatible, by business customers.
Consumers always benefit from the mandatory protections of Italian Legislative Decree 206/2005 (the "Consumer Code") and Directive 2011/83/EU.
By placing an order the Customer confirms having read and accepted these terms, the Returns policy and the Privacy notice.
3. Products and food information
Our products are handmade. Images are illustrative and may differ slightly from the product delivered.
For each product we provide, in accordance with Regulation (EU) 1169/2011, its name, ingredients, allergens, storage instructions and, where applicable, the best-before or use-by date. Our bakery handles products containing allergens, so traces may be present. If you have allergies or intolerances, please contact us before buying.
Each product is identified by an SKU/EAN code and a production lot for traceability.
4. Prices
Prices are in euro and include VAT. They are shown per piece or per kilogram.
For products sold by weight, the price is calculated on the weight ordered. Because products are handmade, the actual weight may vary by up to ±10%; this never results in any extra charge.
Any delivery costs are shown clearly before you confirm the order.
5. Orders and conclusion of the contract
The Customer selects products, adds them to the cart and proceeds to payment, and can review and correct their details before submitting.
The contract is concluded when the Customer receives the order confirmation email, which includes a summary of the applicable terms.
If a product is unavailable, the Seller will inform the Customer and refund any amount already paid without delay.
6. Payment
Payments are processed by Stripe (Stripe Payments Europe Ltd.) through the ByteTech OÜ platform. Card data is handled directly by Stripe under the PCI-DSS standard; neither the Seller nor ByteTech OÜ has access to full card details.
The amount is charged when the order is confirmed.
7. Delivery and pickup
As most products are fresh and perishable, delivery is only available in the areas shown at checkout. Alternatively you can collect your order in store on the chosen date and time slot. Any delivery fee is shown in the cart before payment.
Delivery times are indicative. The Customer, or someone they appoint, must be present to receive the goods: fresh products cannot be left unattended.
The date and time of courier delivery or store pickup are recorded in the order system and are the reference for assessing the condition of fresh products.
Risk of loss or damage passes to the Customer upon delivery (art. 63 Consumer Code).
8. Right of withdrawal
The right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, nor to sealed goods unsealed after delivery (art. 59 Consumer Code). For packaged long-life products you may withdraw within 14 days. You can exercise it online at any time with the “Withdraw from contract” button at the bottom of every page. Full details are in the Returns & withdrawal policy.
9. Legal guarantee of conformity
The Seller is liable for any lack of conformity existing at the time of delivery, under articles 128 et seq. of the Consumer Code.
Given the perishable nature of the products, please check them on delivery or pickup and report any problem as soon as possible, ideally within 24 hours and with a photo, so that we can act promptly. This is only an organisational request: it is not a deadline and does not limit in any way the rights the law gives you.
The condition of fresh products is assessed at the moment of delivery or pickup, whose date and time are recorded. The Seller is not liable for deterioration caused by storage not in line with the product's instructions after delivery, without prejudice to the consumer's mandatory rights.
10. Liability
The Seller is not liable for delays or failed deliveries caused by force majeure or by the Customer (e.g. wrong address, absence at delivery, improper storage after delivery).
Nothing in these terms limits liability that cannot be excluded by law.
11. Intellectual property
The website, code, graphics, layouts, illustrations and content are the property of ByteTech OÜ or its licensors and are protected by copyright. The store's trade name, trademarks and product photos belong to the Seller. Any unauthorised reproduction is prohibited.
12. Customer account, privacy and cookies
You can also buy without registering. If you create an account, you are responsible for the accuracy of your data and for keeping your password confidential; tell us immediately about any unauthorised use. You can edit, download or delete your data and account at any time from your profile.
Personal data is processed as described in the Privacy notice and Cookie policy.
13. Governing law, jurisdiction and disputes
The contract is governed by Italian law, without prejudice to any more favourable protection under the law of the consumer's country of habitual residence (art. 6 Reg. EC 593/2008).
For disputes with consumers, the courts of the consumer's place of residence or domicile have jurisdiction (art. 66-bis Consumer Code).
Consumers may use the alternative dispute resolution (ADR) procedures under Part V, Title II-bis of the Consumer Code. The EU ODR platform was discontinued on 20 July 2025.
14. Changes
These terms may be updated. Orders are governed by the terms in force when the order was placed.
